Metals collective bargaining deal extended

The decision by the Minister of Labour to gazette and extend the 2011 to 2014 main agreement to all parties and nonparties in the metals industry is a “victory” for centralised collective bargain- ing in the industry, says the Steel and Engineering Industries Feder-ation of South Africa (Seifsa).

The agreement was concluded by the department and Seifsa on behalf of the 27 federated employer associations and the industry’s six trade unions, and enabled parties who represented the majority of employers and employees in industry to extend their agreements to nonparties.

It was challenged by the National Employers’ Association of South Africa and the Plastics Converters’ Association of South Africa.

“This extension vindicates a long-held view that agreements entered into between the majority of contesting parties, at considerable cost and power play, must, through statute . . . become the basis on which employers throughout the industry conduct their businesses.”
