Natalie Reyneke
Natalie Reyneke has become a trusted advisor to many employers, contractors, sub-contractors and suppliers.
“I like to get immersed in clients’ businesses by rolling up my sleeves and visiting them on site. My engagement style gives me in-depth understanding of my clients’ concerns to inform contract drafting and negotiation, which is arguably the most important stage of the process,” she says.
Reyneke’s skill in reviewing existing con- tracts informs what the downstream con- tracts should include. Advising all role players in the contractual hierarchy provides a holistic perspective. Some of her recent matters include acting for the employer in the drafting and negotiation of an energy EPC contract, the full FIDIC contract suite for a mine expansion project in Brazil and advising a local subcontractor on a World Bank bespoke agreement for the design and construction of an 80 MW battery storage system.
Michelle Kerr
Michelle Kerr has effectively represented employers, contractors and subcontractors in arbitrations, adjudications and litigation, many of whom utilise her services regularly. Years of practice have given her an understanding of the practicalities and nuances required to navigate these proceedings successfully.
“MDA is South Africa’s only specialist adjudication practice. As the saying goes, the devil is in the detail, and this is especially true in dispute resolution proceedings. In addition to working to successfully resolve disputes, my focus is to expedite matters and thus avoid costly processes for clients,” she says.
Kerr has many years of experience with the standard form contracts and has provided construction adjudication training. Her practice is focused on construction claims management, adjudication, arbitration, and litigation of disputes.
Kerr’s recent dispute resolution matters include an arbitration and various court proceedings for a shipyard owner and an adjudication for a renewable energy project.
Odette Potgieter
Odette has gained in-depth knowledge of all areas that form part of the project life cycle on account of her diverse practice. She advises clients at the early stages, from preparation of contract documentation and negotiation, through to administering disputes on behalf of clients.
Potgieter’s on-site attendance consistently provides added value to contractors and sub-contractors and her vast experience includes the provision of commercial support to contractor and sub-contractor at the Kusile Power Station project. Her skilful application of available mechanisms helps clients to identify challenges early, ensure proper compliance with contractual obligations, manage commercial risks and avoid potential disputes later on.
“The insights and technical understanding MDA gains from our involvement and hands-on approach gives us the edge to guide our construction sector clients and develop innovative strategies to protect their rights and to ensure the best possible results,” she says.
