Gold Fields appeals St Ives native title ruling
JOHANNESBURG (miningweekly.com) – Gold Fields subsidiary St Ives Gold Mining Company has lodged an appeal against a Federal Court of Australia ruling that the regrant of mining tenements held by St Ives, in Western Australia, were not compliant with the correct processes in terms of the Native Title Act of 1993.
The appeal, lodged alongside the State of Western Australia and other resources companies at the Full Court of the Federal Court of Australia, would be heard during the third or fourth quarter of 2015.
“Gold Fields remains strongly of the view that it has at all times complied with its obligations under the Native Title Act of 1993 in respect of its dealings with these tenements.
The Ngadju People, seeking determination of its claim for native title over a parcel of land in the Goldfields region of Western Australia, took to the Federal Courts earlier this year, claiming to hold native titles covering about 250 mining tenements held by St Ives, with 210 of those tenements invalid because the “right to negotiate”, as specified in the Native Title Act, was not upheld.
The court accepted the submissions of the Ngadju People that the regrant of certain of St Ives’ tenements in 2004 by the State was not compliant and invalidated the regranted tenements to the extent that the exercise of rights under the tenements was inconsistent with the Ngadju People’s native title rights.
“St Ives will vigorously pursue its appeal to the Full Federal Court, and remains confident of a favourable outcome through this process,” the gold miner said in an update to shareholders on Friday.
