DWS to seek ratification of Umgeni Water board members
The Department of Water and Sanitation (DWS) says the acting CEO of Umgeni Water Sandile Dube will act as the accounting authority for the State-owned entity until the ratification of board members can be finalised.
Dube will be supported by the acting director-general of the DWS.
The DWS pointed out that then Water and Sanitation Minister Gugile Nkwinti in May 2019 appointed a board of directors for Umgeni Water, with a term to end in April 2023.
Former Human Settlements, Water and Sanitation Minister Lindiwe Sisulu, however, subsequently dissolved the board and appointed an interim board of directors.
The board members took the matter to the High Court in Pietermaritzburg, KwaZulu-Natal, challenging the decision to dissolve their membership and the appointment of an interim board.
The High Court has since delivered its judgment on the matter, which effectively means that the appointment of the interim board was unlawful and subsequently set aside.
This therefore means that the board that was previously disestablished should be reinstated.
However, while the board has been reinstated, their appointment was not endorsed by Cabinet, which requires that, once current Water and Sanitation Minister Senzo Mchunu approves the recommended candidates for appointment, a written submission, including the names of the candidates, has to be presented to Cabinet for endorsement.
Mchunu on October 28 indicated that he intends to ratify their appointment and disestablish the interim board in compliance with the court judgment.
The process of ratification and disestablishment of the board and interim board, respectively, will result in a temporary gap for almost a period of 14 days until Cabinet has ratified their appointment.
