Former President Jacob Zuma has said that he will not comply with the State capture commission of inquiry and will not appear before the commission as requested, defying a Constitutional Court judgment.

He said in a statement that he was not scared of being arrested or sent to jail for his decision.

Zuma, who initiated the State capture commission, said he was being singled out.

He recently tried to apply for Deputy Justice Raymond Zondo to recuse himself on the grounds that Zondo had family ties with him.

“I have never said that I do not want to appear before the commission but have said that I cannot appear before Deputy Chief Justice Zondo because of a well-founded apprehension of bias and a history of personal relations between the Deputy Chief Justice and myself. I have taken the decision by the Deputy Chief Justice not to recuse himself on review as I believe his presiding over the proceedings does not provide me the certainty of a fair and just hearing,” said Zuma.

He added that the recent Constitutional Court decision had created a special and different set of circumstances specifically designed to deal with him by suspending his Constitutional rights and rendering him completely defenceless against the commission.

He compared this to the apartheid government targeting then Pan African Congress leader Robert Sobukwe for his stance on liberation.

In a Monday interview Zuma’s son Edward Zuma said his family fully supports his fathers’ decision and added that they were not worried about Zuma being arrested.
