WA Parliament passes Bill to shift mining royalty administration to finance dept

The Western Australian Parliament has passed the Mining Amendment (Transfer of Royalty Administration) Bill 2025, paving the way for the state’s mining royalty collection and administration to move from the Department of Energy, Mines, Industry Regulation and Safety (DEMIRS) to the Department of Finance’s RevenueWA.

The amendments will see responsibility transferred from the Mines and Petroleum Minister to the Finance Minister, with the Commissioner of State Revenue taking over administration of royalties under state agreements.

Under current arrangements, mineral royalties are administered under the Mining Act 1978, the Mining Regulations 1981, and around 30 State Agreement Acts. These functions have historically been carried out by DEMIRS officials under the oversight of the Mines and Petroleum Minister.

The Bill also amends the Taxation Administration Act 2003, enabling the Commissioner of State Revenue to manage royalty collections for mining agreements.

According to the government, the changes do not alter the rights or obligations of royalty payers but will shift their interactions to RevenueWA, which will integrate DEMIRS expertise with its IT systems to improve compliance and collection.

“I would like to acknowledge the passing of the Mining Amendment (Transfer of Royalty Administration) Bill 2025 through the Western Australian Parliament," said Finance Minister David Michael.

“While the amendments made through this legislation are mechanical in nature, they represent modernisation of the Act and a new way forward for the collection of royalties.”

The state government said the changes align Western Australia with other jurisdictions that have separated policy and administrative functions in mining regulation.
