Tribunal to hear Group Five collusive tendering case

Construction major Group Five is requesting access to the documents that led the Competition Commission to conclude that there was “significant evidence” of the firm’s participation in collusive tendering with counterparts WBHO Construction and Murray & Roberts subsidiary Concor.

In March, the commission referred a case of alleged collusive tendering to the Competition Tribunal after, it said, an investigation found sufficient evidence that Group Five allegedly colluded with WBHO Construction and Concor in respect of a road rehabilitation project.

The parties allegedly agreed that Group Five would submit the lowest bid to secure the contract for a project to rehabilitate a section of National Route 5, between Senekal and Vaalpenspruit, in the Free State.

The commission requested the tribunal impose a maximum penalty of 10% of Group Five’s yearly turnover.

The hearing was expected to start on October 30.
