Transnet welcomes High Court ruling on MNS Attorneys

State-owned Transnet has welcomed the Gauteng South High Court’s ruling on Monday, confirming that law firm MNS Attorneys has the authority to act on its behalf in pursuing those involved in State capture.

MNS is one of a number of law firms that provides services to Transnet.

In a statement on Tuesday, Transnet said MNS was the target of a “smear campaign” owing to its support for the Popo Molefe Foundation, a charitable foundation run by Transnet chairperson Popo Molefe.

Since 2017, MNS has conducted a number of forensic investigations and legal actions on behalf of Transnet.

This has led to the recovery of more than R600-million that was misappropriated from Transnet during the State capture period.

One of its key focuses has been the removal of former Transnet Group CEO Siyabonga Gama.

This included several summonses being served against Gama for the recovery of R189-million, which Transnet alleges is due to the company.

Gama had contested MNS’s right to act on behalf of Transnet –  a claim that was dismissed by the High Court, along with the awarding of a punitive costs order.

“The significance of this should not be underestimated,” said Molefe.

“Some people who do not like what we are doing have tried to make a meal out of the role that lawyers are playing in ensuring justice, even though they act with a strict mandate from Transnet management,” he added.

He indicated that the court ruling confirmed the correctness of the approach that Transnet had taken against those allegedly involved in State capture.
