Tigers Realm goes to court

PERTH (miningweekly.com) – ASX-listed coal miner Tigers Realm Coal has filed an application with the Federal Court of Australia seeking exemption from the government’s sanctions on Russian coal.

In March this year, the Minister for Foreign Affairs designated coal as an import-sanctioned good for Russia, following its invasion of Ukraine, with the Department of Foreign Affairs and Trade (DFAT) finding that Tigers Realm’s coal operations in the European nation would likely be prohibited by these regulations.

The company told shareholders this week that DFAT had invited the company to apply to the Minister of Foreign Affairs for an exemption permit.

“The company does not agree with DFAT’s indicative assessment that its operations comprise a sanctioned import and has filed an application with the Federal Court of Australia seeking declarations that regulation 4A of the Autonomous Sanctions Regulations does not apply to its operations,” Tigers Realm said in a statement.

The company told shareholders that it had not applied for an exemption permit as it had determined it was not appropriate to do so where the company did not consider its operations to fall within the scope of regulation 4A.

The company’s coal assets are located in the vicinity of the Bering Sea coast in the Russian far east. In the March quarter of this year, the miner reported run-of-mine production of 327 000 t, and that was targeting full-year production of between 1.5-million and 1.6-million tonnes.
