Solidarity halts Continental Tyre retrenchments
Trade union Solidarity has successfully obtained an urgent interdict from the Port Elizabeth Labour Court to halt Continental Tyres' move to retrench about 125 employees.
Solidarity, which accused the tyre manufacturer of undertaking an unfair retrenchment process, obtained the interdict prior to a Continental management meeting planned for Monday, where the selection criteria for the layoffs were to be decided.
“Although the interdict provides temporary relief, we are satisfied that the layoffs have been prevented and that we were able to protect our members against the unfair retrenchment process,” Solidarity deputy general secretary Johan Kruger said in a statement.
This followed a month-long National Union of Metalworkers of South Africa- (Numsa-) led strike leading to a “questionable agreement” with Continental that saw it amalgamating its shift system.
The changes, which would lead to retrenchments, had extended to Solidarity members without the union’s knowledge or consent.
“We are of the opinion that our battle against Continental draws renewed attention to the unfairness that often goes hand in hand with the majoritarian principle in the workplace. It is not merely a small victory, but is in fact a larger victory in the struggle against the marginalisation of minority trade unions in the workplace,” Kruger added.
Continental was ordered to cover the costs Solidarity incurred in obtaining the interdict.
