The Construction Law Platform (TCP) is set to revolutionise litigation and arbitration in the South African construction industry.

TCP is the only Law Company in South Africa that offers either, or both, a retainer and contingency, “no win no fee”, fee arrangements. It also offers a unique “Use-it or Bank-it” fee system.

The Construction Law Platform evolved in response to an urgent need for construction companies to have access to affordable, specialised legal assistance to meet their day-to-day compliance, legal challenges and rights enforcement, for example, the right to be paid. This is now more important than ever given the effect of the national lockdown and anticipated post lockdown “fallout” on the industry.

At TCP we understand that currently cash flow is tight and high legal fees are not an option. Our “no win no fee” arrangement is an innovative solution to the reality of expensive litigation and allows TCP to share the risk.

So how does it work? Firstly we determine if the dispute meets the criteria for eligibility namely: Is there a reasonable prospect of success and secondly, is the defendant company solvent? Once this criteria is satisfied a contingency fee agreement is concluded.

Rest-assured that the “no win no fee” arrangement is regulated by the Contingency Fee Act and all our attorneys are registered with the Legal Practice Council of South Africa, which affords protection to all clients who wish to utilise this service.
