Metgasco and NSW govt agree to review date

PERTH (miningweekly.com) – The New South Wales government has set June 27 as the date to review the suspension of ASX-listed Metgasco’s drilling activities at the Rosella operation.

Metgasco said on Monday that the company had agreed to the June 27 deadline, following a commitment by the New South Wales government to use its "best endeavours" to make a decision on whether to maintain the suspension of Rosella, and to make the documentation available on which the government had made its suspension decision.

The government’s Office of Coal Seam Gas (OCSG) last month suspended Metgasco’s approval to drill at the Rosella well. Metgasco subsequently launched an appeal for a judicial review in the Supreme Court, in the hopes that the judicial review proceedings would set aside the OCSG’s decision.

Metgasco claimed that the decision was unlawful because it was not authorised by legislation, and was made without affording the company procedural fairness.

Metgasco on Monday told shareholders that it was reserving its right to pursue other options, including a claim for damages to compensate the company for losses resulting from the peremptory suspension of drilling.

However, the company said that it would also continue to work with OCSG to deliver the benefits provided by a natural gas industry in New South Wales, without prejudicing the legal proceedings currently under way.
