Icasa moves on MTR review

The Independent Communications Authority of South Africa (Icasa) on Thursday started a new process to review the wholesale voice call-termination markets after its 2013 glide path was declared “invalid and unlawful” by the South Gauteng High Court in March.

In February, MTN and Vodacom took Icasa to court, challenging its Second Call Termination Amendment Regulations 2014, which had an aggressive asymmetry rate that largely favoured smaller operators, and sought to have the regulations reviewed and set aside.

The South Gauteng High Court had suspended its decision for a six-month period from April to September to allow Icasa to complete a costing exercise and “correct” the “irrational and arbitrary” determination of the regulations fairly.

The regulator would now re-review the wholesale voice call-termination markets, the effectiveness of competition and the application of pro-competitive measures in those markets after a minimum of three years.

Icasa engaged stakeholders to obtain both market and cost-related information and called on licensees to respond to its 2014 call termination regulatory review questionnaire by June 13.

Licensees were also invited to a “questionnaire clarification” workshop at Icasa’s offices, in Sandton, on Friday.
