Court rejects bid to stop Maules Creek start

PERTH (miningweekly.com) – Coal miner Whitehaven Coal is gearing up for construction at its Maules Creek, in New South Wales, after the Federal Court dismissed an injunction against the start of construction work.

The injunction was brought by environmental group Northern Inland Council for the Environment, or NICE, in an effort to halt construction before a judgment was made in a separate case that was challenging the validity of the former Environment Minister’s approval of the mine.

Whitehaven MD and CEO Paul Flynn said on Thursday that the dismissal was an "obvious positive" result for the company.

“The Maules Creek project has been through one of the most rigorous planning approvals processes at both state and federal levels ever undertaken by a mine in New South Wales.”

The $767-million Maules Creek operation received the green light in early July to extract some 13-million tons of coal a year, with first coal delivery expected by the second half of 2014.

The project would employ some 340 workers and contractors during construction, and 470 during operations.

Flynn added that coal production remained on target for the first quarter of 2015.
