Vinpro dismayed court will not hear its urgent interim interdict application

Industry body Vinpro has advised that its urgent interim interdict application to lift the ban on wine sales in the Western Cape will not be heard.

The interim interdict application was confirmed to be heard on July 7, after being postponed from the initial date of July 2, after Vinpro launched an urgent application on June 29, a day after the latest liquor ban came into force.

Two duty judges for the hearing of urgent applications this week have both indicated that they will unfortunately not be in a position to hear the interim interdict application on July 7, as they have already been appointed to hear Vinpro’s main application set down for hearing starting August 23 to 26.

No alternative judges are available.

Vinpro’s legal team immediately approached the Judge President on an urgent basis to arrange for the hearing of the interim interdict application before a new judge on a date to be arranged.

“We are extremely disappointed by this turn of events and are currently in urgent consultation with our legal team on the way forward,” says MD Rico Basson.

The initial litigation started when Vinpro approached the High Court on January 27 to seek urgent relief during the previous liquor ban. This was subsequently postponed when the restrictions were lifted and the matter was set to be heard in the Western Cape High Court in August.

Vinpro, however, reserved the right to launch an interim interdict in case of a full ban being reinstated before the court date.
