After hearing industry body Vinpro’s case for the Western Cape to deviate from the national liquor ban, the High Court has reserved judgment on the matter.

Vinpro’s urgent interim interdict application to enable off- and on-site consumption and sale of liquor in the province was heard by Judge Noluthando Nziweni on July 21.

Vinpro MD Rico Basson says he hopes for a positive outcome and awaits feedback on this principle that would govern decision-making regarding future wine sales bans.

He says many efforts from the wine industry to actively engage with national government over the past 16 months have only been met by a lack of proper consultation and assistance.

The industry body remains committed to see through its main court application that is set down for hearing, also in the Western Cape High Court, before a full bench of judges from August 23 to 26.

The initial litigation started when Vinpro approached the High Court on January 27 to seek urgent relief during the previous liquor ban. This was subsequently postponed when the restrictions were lifted and the matter was set to be heard in the Western Cape High Court in August.

Vinpro, however, reserved the right to an interim interdict in case of a full ban being reinstated before the court date.

The industry body represents about 2 600 South African wine producers, cellars and industry stakeholders.
