Business group Sakeliga is dropping its legal action against Sedibeng Water after the water agency agreed to withdraw its instruction for the cut-off of water supply services in several municipalities in the North West.

On May 25, Sedibeng Water issued a suspension notice, effective June 1, for the supply of bulk water and operational and maintenance services in some parts of the province.

The suspension would have impacted the Ngaka Modiri Molema district municipality, as well as the Mahikeng, Ditsobotla and Ratlou local municipalities. It involves towns such as Mahikeng, Lichtenburg, Delareyville, Ottosdal, and Zeerust.

Sakeliga at the time requested the withdrawal of the suspension, failing which, it would file an urgent application to ask the High Court for an appropriate interdict.

“[Sedibeng Water] requested Sakeliga not to proceed with urgent litigation in the Mahikeng High Court,” said Sakeliga CEO Piet le Roux.

Le Roux said the looming litigation was evidently crucial to maintaining the water supply.

“In light of the undertaking, Sakeliga instructed its legal team to remove the case from the urgent roll and reserve legal costs. Should Sedibeng Water act contrary to their undertaking, they can expect swift action from Sakeliga,” he concluded.
