The National Union of Metalworkers of South Africa's (Numsa) urgent application to be able to appeal its expulsion from Cosatu at the federation's Special National Congress (SNC) in July has been thrown out of the High Court in Johannesburg.

''I have come to the conclusion that this matter is not urgent,'' said Judge Mandla Mbongwe, to sighs of disappointment from the Numsa supporters in the public gallery.

''The matter is struck off the roll for lack of urgency. The applicant is ordered to pay the costs in respect of the respondent.''

This had to include the cost of two counsel.

Numsa had tried to secure an urgent application to be allowed to attend the Congress of South African Trade Union's SNC on July 13 and July 14, and for the SNC to be declared as having the powers to hear its appeal against its expulsion last November.

Wednesday's ruling means that Numsa will have to wait until November for Cosatu's second congress of the year, to hear its appeal.

Mbongwe said Numsa had not used the time between its expulsion, and an unsuccessful attempt in February at having its appeal heard, to approach the courts urgently.

He said the urgent court roll was to ''extinguish fires'', and that it was not meant for long drawn out matters to be heard.

Numsa had hoped to be allowed to have the matter heard before Cosatu started its credentials process on Wednesday for July's conference.
