Lynas' Malaysian ops called into question

PERTH (miningweekly.com) – Rare earths miner Lynas on Tuesday alerted shareholders to judicial review proceedings before the Kuantan High Court in Malaysia by an anti-Lynas activist in relation to the permanent disposal facility (PDF) for water leach purification residue.

Lynas’ PDF for water leach purification residue received environmental approval from the relevant Malaysian regulatory authorities in December 2021. The design for the PDF complies with national and international standards and builds on the nine years of safe operation of residue storage facilities in Malaysia.

Lynas told shareholders on Tuesday that while the company is not named as a party to the proceedings, it intends to seek leave to intervene to ensure the Court is properly informed.

“Lynas has full confidence in the robustness of the Malaysian judicial system. While every case will be decided on its merits, the applicant, and persons believed to be associated with him, have lodged multiple previous court challenges, all of which have been dismissed,” Lynas said in a statement.

Lynas Malaysia has been the subject of four independent scientific reviews, including two reviews by the International Atomic Energy Agency (IAEA) and the Malaysian government’s 2018 Executive Review Committee. All of the reviews have found that Lynas Malaysia is low risk and compliant with the relevant laws and regulations.

The 2015 IAEA report stated that “...the fears demonstrated by those who oppose the continuation of the operations did not find any support on scientific evidence”.
