ANC withdraws application to reopen IEC’s candidate registration system

The African National Congress (ANC) has announced its decision to withdraw its application with the Electoral Court to get the Independent Electoral Commission of South Africa (IEC) to amend the electoral timetable and reopen candidate registration to allow the party to submit its final list.

The ANC will now wait on a ruling by the Constitutional Court on whether it will allow for the postponement of the local government elections scheduled for October 27.

On Tuesday ANC deputy secretary-general Jessie Duarte told the Electoral Court the ANC's incomplete candidate list, ahead of the local government elections, affected 93 municipalities out of 257. 

The IEC had extended its deadline to 21:00 on August 23 to allow political parties and independent candidates intending to contest the local government elections to submit their nominations and prescribed election deposits.

The ANC argued that it suffered technical difficulties in uploading the candidate list to the IEC portal and had attributed the delays to a range of issues, including the Covid-19 lockdown regulations.

The party argued that the application was brought to protect the rights of South Africans who will now be deprived of their right to vote for a candidate of their choice as a result of the inability of the party to register its candidate.

Meanwhile, the IEC has approached the Constitutional Court to have the local government elections postponed, saying that it is not possible to hold free and fair elections during the Covid-19 pandemic.

The commission wants the court to declare that it can hold the local elections outside of the required 90-day period and to direct that the elections can be held no later than February next year. 

“Accordingly, in view of the fact that the matter is before the Constitutional Court, the ANC has decided to withdraw its application and to await the judgment of the Court,” the party said.
