Agri SA says court ruling of State-controlled FMD vaccine procurement must be respected

Although it is regrettable that there is contention about government’s approach to dealing with foot-and-mouth disease (FMD) in the country amid one of the worst outbreaks and animal crises ever experienced, industry body Agri SA says the latest Gauteng High Court order must be respected.

The court ruled in favour of the Department of Agriculture (DoA) on March 24, affirming the State’s authority to manage FMD vaccine procurement, with industry organisations Sakeliga, Southern African Agri Initiative and Free State Agriculture having argued that the private sector ought to be allowed to procure and administer vaccines.

The court directed the DoA to promulgate and publish the intended animal health scheme for FMD in the Government Gazette by April 17, which mandates government to formalise the FMD vaccination framework.

The framework has been heavily debated in the industry, with the litigation applicants in the matter believing the national response has been too slow and flawed, which leads to prolonged exposure and risk to farmers.

Agri SA says FMD remains a national priority with significant implications for livestock, food security and exports. The organisation calls for urgent unity and coordination across all stakeholders and that vaccination, traceability and disease management efforts be accelerated.

Although the court ruled in favour of the DoA in the matter, government was ordered to pay the applicants’ legal costs owing to “how the matter was allowed to reach an unproductive hearing”.

The matter is set to be heard again on April 28, during which the content and practicality of the FMD scheme will be scrutinised.
