Tribunal requests additional information from commission in construction application

The Competition Tribunal has issued an order for the Competition Commission to file supplementary applications relating to three companies that the commission wants added as parties to two complaints relating to the Gautrain rapid rail link project and the Lesotho Highlands Water Project.

The tribunal on Wednesday heard applications brought by the commission that were linked to the 2011 Construction Fast-Track settlement process.

The companies are Esor Africa, Franki Africa and Geomech. Esor Africa and Franki Africa are independent companies and subsidiaries of Esor.

The commission was requested to say when it initiated the complaint against the three companies and to make it clear which allegations in its referral related to which specific initiation.

It would have 30 working days to provide the supplementary applications.
