Shipping liner admits liability for price fixing

Norwegian shipping liner Wallenius Wilhelmsen Logistics (WWL) has reached a settlement agreement with the Competition Commission for contravening the Competition Act, agreeing to pay an administrative penalty of R95.7-million.

This settlement followed the commission’s investigation of collusive conduct by shipping liners, including WWL, which allegedly fixed prices, divided markets and tendered collusively in the provision of deep-sea transportation services, which entailed the transportation of motor vehicles, equipment and machinery by sea to and from South Africa.

The commission found that WWL colluded with its competitors on 11 tenders issued by several automotive manufacturers for transport services to and from South Africa. WWL admitted to this collusive conduct.

The commission filed the settlement agreement with the Competition Tribunal on Thursday for confirmation.
