Newsflash: Automobile Production and Development Programme Phase 2 ready to go!

Amendments to the Customs and Excise Act were gazetted on Friday 25th June 2021 which finally allow for the implementation of Phase 2 of the Automotive Production and Development Programme (APDP2). The following changes were seen: -

Amendment to Schedule 1: Rebate Item 317.04 is added to Schedule 1 of the Act. Rebate Item 317.04 is effectively the rebate item that enables the APDP2 to come into existence for implementation.

Amendment to Schedule 3: The amendments to the item and its accompanying notes for the APDP2 to be implemented. The amendment introduces the changes as specified in the APDP2 regulations of Production Rebate Certificates (PRCs), Volume Assembly Localisation Allowance (VALA). This is the fundamental change from APDP Phase 1 to APDP Phase 2.

The amendments do not see the termination of Rebate Item 317.03 or the removal of the associated implementation of the APDP (Phase 1). The APDP Phase 1 will still be around for some time before all obligations and benefits under Phase 1 are expunged.

Amendment to Schedule 4: This amendment sees the inclusion of Rebate Item 317.04, PRCs and VALA added to the existing Rebate Item 317.03, Production Rebate Credit Certificates and Volume Assembly Allowance (VAA) reflected under Rebate Item 460.17.

Amendment to Schedule 5: The Schedule 5 amendment makes for the inclusion of Rebate Item 317.04 and application of PRCs to Refund Items 536.00 and 537.04.

It is now effectively possible for the APDP2 to be implemented on 1 July 2021 as the Minister of Trade, Industry and Competition has been promising.

The supporting Info Docs A, B and C have been published in their final form for implementation on ITAC’s (International Trade Administration Commission) website.
