Labour Court orders Numsa to cease strike violence in Ngqura

The Labour Court has ordered the National Union of Metalworkers of South Africa (Numsa) and its members to immediately cease all “acts of violence, intimidation and lawlessness” against nonstriking workers at the Ngqura container terminal, in the Eastern Cape.

Ruling in favour of freight logistics group Transnet and its employees on Friday, Labour Court judge Edwin Tlhotlhalemaje ordered Numsa and its striking members at the terminal to immediately stop intimidating, assaulting or threatening to assault people working at the terminal; causing damage to property, vehicles or buildings of Transnet and its employees; and inciting, encouraging or intimidating any person to commit an act of violence against Transnet, its employees, their families and properties.

In addition, the judge ordered Numsa to inform its striking members that their conduct was unlawful and that they should stop the acts of violence.

Transnet sought to interdict Numsa after homes belonging to Transnet workers were petrol-bombed in the early hours of Friday morning, while two vehicles, also belonging to nonstriking workers, were torched in allegedly coordinated attacks.

Transnet said in a statement on Monday that two more houses belonging to nonstriking workers were stoned in the early hours of Saturday, despite the interdict. 

“This we view as flagrant contempt of the court’s decision. The latest incidents take the number of such attacks to a shocking 30 since the union, which represents a minority of Transnet’s over 60 000 workers, vowed to intensify its action against the company three days ago. The majority of our colleagues do not belong to Numsa,” said the group.

Numsa could not be reached for comment on Monday.
