Eskom vows compliance with Westinghouse court order

State-owned Eskom on Monday said it has fully complied with the September 5 South Gauteng High Court order demanding the power utility provide Westinghouse Electric Company with all the documents relating to the tender for the replacement of steam generators at the Koeberg nuclear power station.

Despite Westinghouse’s “repeated assertions” that Eskom refused to comply, several confidential documents had been handed over, in full compliance of the order of the court, the utility stated.

Eskom had now also embarked on a process to determine the confidentiality and/or commercial sensitivity of certain information Westinghouse was demanding access to.

Eskom’s senior council in the matter would apply the agreed confidentiality regime set within the court order as a mechanism to deal with information that could be deemed either commercially sensitive or confidential.

The R4.3-billion contract, awarded to French company Areva in August, was brought into dispute in September when Westinghouse contested the tender process, obliging Eskom to supply it with documents outlining the basis for the utility’s procurement decision.
