Cell C questions Icasa process over MTR regulations

South Africa’s third-largest mobile operator Cell C has made a bid to the South Gauteng High Court to review the Independent Communications Authority of South Africa’s (Icasa’s) promulgation of the much disputed Call Termination Regulations.

Cell C CEO Jose Dos Santos said the operator did not agree with the regulations that would guide the interconnect rates charged by mobile operators implemented by Icasa in October last year and aimed to scrutinise the factors behind the authority’s decision to promulgate the rates.

In September, Icasa finalised the long-awaited mobile termination rates (MTRs) after a court-ordered review of the pricing process used to determine the rates.

The MTRs remained at the 20c rate, with an asymmetry rate reduced from the initial 44c to 31c, at the start of the new glide path from October 2014 to September 2015.

Following this, the MTR would decline to 16c, with an asymmetry of 24c until the end of September 2016, before dropping to its final rate of 13c, with an asymmetry of 19c.

However, Cell C planned to determine the process Icasa followed – and what information it relied on – in making its decision by reviewing all the correspondence between Icasa and the network operators and other parties; the authority’s meeting minutes’ reports from experts on behalf of Icasa’ various presentations made; and any other related documents.

“Once Cell C has received the full record and has studied it in detail together with its legal advisers, economists and other experts it will decide what further steps to take in this matter,” said Dos Santos.
